Posted by Resident Egoist in : Politics , trackbackA proper legal system assumes the innocence of the accused until his guilt is positively proven beyond reasonable doubt, according to predefined, ojective rules of evidence. British Prime Minister Tony Blair — being the statist that he is — apparently cannot stand this. Hence his vow to “turn the British legal system on its head” by instituting a new law that would demand anyone accused of any crime to prove his own innocence in court; i.e., in Britain, now people accused of a crime are considered guilty until proven innocent.
Mr. Blair’s cited reason for this change is the alleged fact that the present legal system is inadequate to combat emerging “new types of crime” [read: victimless crimes], and also, the executive branch of government is too incompetent and lazy to perform all the steps presently necessary for the effective prosecution and incarceration of a person charged with an offense. The new system of “summary justice” is supposed to be a remedy to this.
